Welcome to Gosotek. By accessing or using our website, you agree to these Terms & Conditions. Please read them carefully to understand your legal obligations and the rules that govern your use of our services.
Acceptance
By using https://www.gosotek.com/ or engaging our Services (web/app development, digital marketing/SEO, e-commerce, UI/UX, IT consulting, cybersecurity), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. Users must be 18+ and authorized to contract.
Key Definitions
This document is an electronic record in terms of the Information Technology Act, 2000, and rules thereunder as applicable, and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.
This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011, that require publishing the rules and regulations, privacy policy, and Terms of Use for access or usage of the domain name https://gosotek.com (“Website”), including the related mobile site and mobile application (hereinafter referred to as “Platform”).
The Platform is owned by GOSOTEK TECHNOLOGY PRIVATE LIMITED, a company incorporated under the Companies Act, 1956, with its registered office at FIRST FLOOR, A-103, RIZVI PALACE CHS LTD, HILL ROAD, MATIX SHOWROOM, BANDRA WEST, MUMBAI, MUMBAI SURBAN, MAHARASHTRA, 400050 (hereinafter referred to as "Platform Owner," “we,” “us,” or “our”).
Your use of the Platform, services, and tools are governed by the following terms and conditions ("Terms of Use") as applicable to the Platform, including the applicable policies which are incorporated herein by way of reference. If you transact on the Platform, you shall be subject to the policies that are applicable for such transactions. By mere use of the Platform, you shall be contracting with the Platform Owner, and these terms and conditions, including the policies, constitute your binding obligations with the Platform Owner.
These Terms of Use relate to your use of our website, goods (as applicable), or services (as applicable) (collectively, “Services”). Any terms and conditions proposed by you which are in addition to or which conflict with these Terms of Use are expressly rejected by the Platform Owner and shall be of no force or effect. These Terms of Use can be modified at any time without assigning any reason. It is your responsibility to periodically review these Terms of Use to stay informed of updates.
For the purpose of these Terms of Use, wherever the context so requires, "you", “your,” or "user" shall mean any natural or legal person who has agreed to become a user/buyer on the Platform.

ACCESSING, BROWSING, OR OTHERWISE USING THE PLATFORM INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THEM CAREFULLY BEFORE PROCEEDING.
Services & Availability
Scope, timeline, milestones, and fees are defined in a SOW/Project
Agreement. Website access is 24/7; maintenance or force-majeure may cause downtime.
Accounts & Acceptable Use
Keep credentials secure; you’re responsible for account activity. No illegal use, IP infringement, malware/spam, scraping, reverse-engineering, or attempts to bypass security.
Pricing & Payments
· Standard schedule: 50% advance (start), 25% on submission, 25% before delivery/go-live.
· Retainers/hourly/performance models must be agreed in writing.
· Prices valid 30 days; GST, currency fees, licenses, hosting, and scope changes are extra.
· Late fee: 1.5% per month. Invoices: Net 15.
Deliverables, Revisions & Acceptance
· Client has 7 business days to review; silence = acceptance.
· Up to 2 revision rounds within scope; extra changes billed.
· Completion = accepted deliverables + final payment + IP transfer (if applicable).
Intellectual Property
· Custom work made for Client transfers on final payment.
· We retain rights to our pre-existing tools, frameworks, methods, and branding.
· Third-party components remain under their licenses; Client must comply.
· Portfolio use (name/logo/case study) unless you opt out via privacy@gosotek.com.
Warranty & Support
· 30-day warranty: bug fixes within original scope.
· Excludes third-party/plugin issues, Client-made changes, hosting/server faults.
· Paid support: SLAs/retainers available (business hours: 9am–6pm IST, Mon–Fri).
Disclaimers & No Guarantees
Services are provided “as is” except stated warranties. We do not guarantee rankings, traffic, conversions, revenue, or third-party platform outcomes
Liability Cap
To the maximum extent allowed by law, we’re not liable for indirect/special/consequential damages or data loss. Our total liability is the amount you paid for the project or ₹1,00,000 (whichever is lower). Exceptions: confidentiality/IP claims,
indemnity, gross negligence, death/personal injury.
Indemnity
· Client indemnifies Gosotek for claims arising from Client content, law violations, misuse, or negligence.
· Gosotek indemnifies Client for third-party IP infringement by our deliverables (with prompt notice and control of defense).
Confidentiality
Both parties will protect confidential information; use only for the project; return/destroy on request. Survival: 5 years (source-code obligations may continue longer).
Data Protection
We follow applicable Indian data laws and process personal data per the SOW and our Privacy Policy. Breach notices to Client within 72 hours of discovery.
Termination
· Either party may terminate with notice (as per SOW).
· We may suspend/terminate for non-payment, legal violations, abuse, or confidentiality breaches.
· On termination: fees due immediately; we may retain work-in-progress and IP until paid.
Dispute Resolution
Good-faith negotiation → optional mediation (Kota/Jaipur) → binding arbitration (Arbitration & Conciliation Act, 1996; Kota/Jaipur; EN/HIN). Courts of Kota/Jaipur, Rajasthan have exclusive jurisdiction where litigation applies. Governing law: India.
Force Majeure
No liability for delays/failures due to events beyond reasonable control (natural disasters, war, strikes, pandemics, utility/internet failures). Payment obligations still apply.
Time Limit to Claim
Any claim must be filed within 1 year of the cause of action.
Third-Party Services
Integrations (e.g., Razorpay/PayU/Stripe, AWS/GCP/Azure, analytics, email, social) have their own terms and privacy practices. Client maintains accounts, licenses, and pays third-party fees.
Security & Backups (Summary)
HTTPS, encryption, firewalls, audits; daily backups with ~30-day retention; defined RTO/RPO per SOW.
Changes to Terms
We may update Terms with 30 days’ notice via email/website. Continued use = acceptance. Prior versions may be archived.
